Injunction against Little Downham waste site

A court injunction has been filed against waste being imported on land in Little Downham.

The application was made by Cambridgeshire County Council for the site at First Drove and Black Bank.

At a planning meeting last week (July 19), Deborah Jenkins, principal enforcement and monitoring officer, said: “On June 12 a case management conference took place at The High Court in London in respect of the council’s application to prevent further importation of waste onto agricultural land.

“A hearing was set for July 23 and 24, at The High Court in London, to decide whether to grant the council’s request for an injunction with an additional penal notice in the event that he injunction is breached.

“At the case management conference, the defendants agreed to a formal undertaking that: ‘until the conclusion of the trial or further order, they shall not whether by themselves, or instructing, encouraging or allowing another, import any material on to the land’.

“This is a signed and sealed undertaking, it is legally binding upon them, and any breach of the undertaking is contempt of court that is taken very seriously”.

Chairman, Councillor David Connor, thanked Ms Jenkins and her department for the work that they have done in getting this hearing listed soon, especially as the judge in the case had originally mooted possible court dates in February-April 2019.

Cllr Connor also informed his fellow committee members that the defendant in question had recently been elected as vice chairman on his local parish council.
