MEPAL teenager Adam Day stopped by the roadside to answer a call of nature when a 17-year-old drink driver jumped behind the wheel of his car.

The youth refused to get out, so Day allowed him to drive to the end of the road, Ely magistrates heard on Thursday.

Eighteen-year-old Day had admitted permitting the 17-year-old to drive without insurance and using the car without insurance.

He tried to persuade magistrates that there were special reasons why they should not endorse his licence - but he failed, and the resulting six points on his driving record means DVLA will revoke his licence.

Sgt Kenneth Moffat told the court that he stopped the Renault Megane in Common Road at Witchford on December 1 because the fog light was on. The driver admitted he had no licence and no insurance.

In the witness box, Day said the insurance policy covered only himself, his mother and step-father.

He had taken three friends into Ely on December 1, and on the way home stopped to relieve himself. His 17-year-old friend got into the driver's seat, and "wanted to have a go in it."

Because the youngster persistently asked to drive, Day had agreed, but not willingly, he said.

"My client had lost control of his vehicle, but not voluntarily," said Mr Milsom. "The other teenager was determined to drive.

"My client made some protest, and contemplated some physical action, but was afraid of what that might lead to," he continued. "He wanted his car back, and the quickest way to get it back was to sit in the passenger seat and reluctantly give verbal permission for the car to be driven to the end of the road."

Day was fined £100 with £50 costs.
